This end-user licence agreement is a legal agreement between you (User) and Event Zero Pty Ltd ACN 110 659 375 (Event Zero) regarding your use of the Event Zero software product provided to you with this agreement (Software Product). The Software Product includes all programs, data and printed or electronic documentation. By installing, copying or otherwise using any part of the Software Product you agree to be bound by the terms of this agreement. Acceptance binds you and your organisation to the terms of this agreement and by accepting the terms of this agreement you confirm that you are authorised to enter into this agreement on behalf of your organisation. If you do not agree with the terms of this agreement you must not install, use or copy the Software Product in any way.

1. Licence

   Event Zero licenses the User to use the Software Product on the following conditions:

   1. The User must only use the Software Product as a single product. The Software Product is licensed as a single product and its component parts must not be separated for use in conjunction with more than one computer. The User may use the Software Product on more than one computer.
   2. The licence is non-exclusive and must not be transferred, assigned or dealt with in any way. The User may only use the Software Product for the User’s own internal purposes and must not sublicense, lease or loan the Software Product or any part of it to any other person.
   3. The User may make one backup copy of the Software Product. The backup copy must only be used for archival purposes. Except as permitted by law and this agreement, the User must not otherwise copy, reproduce or transmit the Software Product in whole or in part.
   4. The User must not reverse engineer, decompile or dissassemble the Software Product or otherwise reduce it to a human readable form, except to the extent that doing so is expressly permitted by law and any right to do so cannot be excluded.
   5. Any other rights of the User in relation to the Software Product are excluded or limited to the extent permitted by law.
2. Termination

   The licence to use the Software Product terminates immediately, without notice to the User, if the User breaches any term of this agreement. When this licence terminates the User must destroy or return to Event Zero the original and all copies of the Software Product and has no right to any refund of any amount paid for it.

3. No Other rights

   This licence entitles the User to use the Software Product in accordance with the terms of this agreement, but does not confer any other rights to or in connection with the Software Product.

4. Ownership

   The Software Product is protected by intellectual property laws and international intellectual property treaties. All copyright in the Software Product (or any part of it, whether or not incorporated into any other software), related patents and other intellectual property rights in respect of or in connection with the Software Product are and remain in the ownership and under the control of Event Zero. This agreement grants the User a licence to use the Software Product, and the Software Product is not sold to the User.

5. Maintenance and support

   No maintenance or support for the Software Product is provided by Event Zero under this agreement. The User is encouraged to report bugs and defects through online forums provided by Event Zero.

6. Updates

   Event Zero is not required under this agreement to provide the User with any new releases, patches or upgrades which Event Zero may create. The User is encouraged to join the online support community provided by Event Zero to be advised of new releases, patches or upgrades.

7. Limited warranty

   Event Zero warrants that the media on which the Software Product is provided to the User is free from any defect in materials or workmanship that prevents the use of that media by the User as intended under this agreement. This warranty expires 90 days after the delivery to the User of the media.

8. User remedies

   To the extent permitted by law, and except as provided under the limited warranty in clause 7, all terms, conditions, warranties, undertakings, inducements or representations whether express, implied, statutory or otherwise relating in any way to the Software Product are excluded. The User agrees that it has relied on its own skill and judgement in deciding to use the Software Product and that no representation has been made regarding any benefit to be obtained from the acquisition or use of the Software Product.

   To the extent permitted by law, any liability of Event Zero in relation to the Software Product and media on which it is provided, whether under the limited warranty in clause 7 or under any term, condition, warranty, undertaking, inducement or representation that by law cannot be excluded or that is not otherwise excluded by this agreement is limited at the option of Event Zero to the replacement, repair or resupply of the Software Product or media or the cost of the Software Product or media.

   To the extent permitted by law, all liability of Event Zero in relation to the supply or non-supply of the Software Product or media on which it is provided is excluded in respect of any indirect or consequential damage, expense or loss suffered or incurred by the User, and in any event (whether it is direct or indirect) in respect of any business interruption, lost revenue or profits, loss of goodwill and lost or corrupted data.

9. Applicable law

   This agreement is governed by the laws of Queensland, Australia. The User submits to the exclusive jurisdiction of the courts of Queensland, Australia and agrees that any lawsuit must be heard in those courts.
